WARMA PROSECUTION SECURES FIRST CONVICTION
The Water Resources Management Authority (WARMA) has secured its first conviction in the Kasama District Court in a case involving Kampoko Resources Limited, for illegal construction of a dam without permit.
Particulars of the offence are that Kampoko Resources Limited, a company incorporated in Zambia and having its registered office in Kabwe and Everisto Mutambo and Alice Mambwe Chabuka being Directors of the company, on unknown dates but between 2nd and 17th may, 2019 in Kasama District of Northern Province of the Republic of Zambia, did commence construction of a dam without a lawfully issued permit by the Water Resources Management Authority (WARMA) as required under section 110 (1) and (2) of the Water Resources Management Act No 21 0f 2011.
On 31st July, 2019, the Authority ‘s Prosecutor, Mr Emmanuel Mumba, successfully prosecuted the Directors of Kampoko Resources Ltd before Honourable Samboko, sitting at the Kasama Magistrate Court. Hon. Samboko has convicted the Directors of Kampoko Resources for construction of a dam without a permit.
The Authority is elated by this development, as previously it understandably took the leaner path of privately resolving offences with offenders, and hopes that this course will result into deterrence of would be offenders.
